Terms of Service
Please read these terms carefully before using Jumpcut.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and MILA APPS LTD ("Company", "we", "us", or "our"), a company registered in England and Wales with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.
By accessing or using Jumpcut (the "Service"), including our web application, iOS application, and any related services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Jumpcut is a video editing application that automatically detects and removes silent segments from videos. The Service includes:
- AI-powered silence detection
- Video processing and editing tools
- Audio enhancement features
- Export functionality in various formats
Local Processing
All video processing occurs locally on your device. Your video files are never uploaded to our servers, ensuring complete privacy of your content.
3. User Accounts
3.1 Account Creation
To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.
4. Subscriptions and Payments
4.1 Free and Paid Plans
Jumpcut offers both free and paid subscription plans. The free plan includes basic features with certain limitations. Paid plans ("Pro") provide additional features and remove limitations.
4.2 Billing
- Subscriptions are billed in advance on a recurring basis (monthly or annually)
- Payment is processed through the platform where you subscribed (Apple App Store, web)
- Prices are subject to change with reasonable notice
4.3 Cancellation and Refunds
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- Refunds for App Store purchases are handled according to Apple's refund policy
- For web subscriptions, refund requests are handled on a case-by-case basis
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Process content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Attempt to reverse engineer, decompile, or disassemble the Service
- Circumvent any access controls or usage limits
- Interfere with or disrupt the Service or servers
- Use automated systems to access the Service without permission
- Share your account credentials with others
6. Intellectual Property
6.1 Our Intellectual Property
The Service, including its original content, features, and functionality, is owned by MILA APPS LTD and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Your Content
You retain all rights to the videos and content you process using Jumpcut. Since all processing happens locally on your device, we do not have access to, nor do we claim any rights over, your content.
6.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.
7. Third-Party Services
The Service may integrate with or link to third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- The quality of the Service will meet your expectations
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILA APPS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or other harmful code transmitted through the Service
- Any errors or omissions in any content
Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or £100, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless MILA APPS LTD and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MILA APPS LTD regarding the Service and supersede all prior agreements and understandings.
